
In accordance with the provisions of Article 11 of Law No 38/2003 on taxi transport, as subsequently amended and supplemented, the term "taxi transport manager" means: the natural person employed by an authorised carrier who is a legal person or a family association and who permanently and effectively manages the carrier's taxi transport activities.
The professional training and certification of taxi transport managers is regulated by:
- Law No 38/2003 on Taxi and Hire Transport, as subsequently amended and supplemented;
- The rules on the training and professional certification of road taxi transport managers approved by Government Decision No 879/2016.
According to Art. 1 para. (2) of the Rules approved by Government Decision no. 879/2016, persons who meet the conditions set out in Art. 7^1 para. (1) lit. b)-d) of the Act no. 38/2003 on taxi transport, as amended, i.e.:
- they meet the conditions of good repute set out in Article 9(1)(a) and (b) of this Regulation (1) (d) point 1;
- is a high school graduate, with or without a baccalaureate diploma;
- is currently resident in Romania, within the meaning of Article 26(1)(a) of the Constitution. (2) of Regulation (EU) No 165/2014 of the European Parliament and of the Council of 4 February 2014 on tachographs in road transport and amending Regulation (EC) No 561/2006 of the European Parliament and of the Council on the harmonisation of certain social legislation relating to road transport, published in the Official Journal of the European Union, L series, No 60 of 28 February 2014.
The conditions of good repute referred to in Article 9(2)(a) and (b) shall be met. (1) letter d) point 1 of Act No. 38/2008 on transport by taxi and for hire, as subsequently amended and supplemented, is fulfilled if the criminal record certificate shows that the person concerned has not been convicted of:
- offences against safety on public roads;
- offences relating to drug trafficking and consumption;
- offences against life, health and bodily integrity;
- offences relating to trafficking and exploitation of vulnerable persons;
- offences against sexual freedom and integrity;
- crimes against property.
For the purposes of Article 26 para. (2) of Regulation (EU) No 165/2014 of the European Parliament and of the Council of 4 February 2014 , "usual residence" means the place where a person usually lives, namely at least 185 days per calendar year, by virtue of personal and occupational ties or, in the case of a person without occupational ties, by virtue of personal ties indicating a close connection between that person and the place where he or she lives.
However, the current residence of a person whose occupational ties are in a place other than that of his personal ties and who therefore lives alternately in several places situated in two or more Member States shall be considered to be the place where he has personal ties, provided that he returns there regularly. The latter condition is not required if the person resides in a Member State in order to pursue an activity of a fixed duration.
After completion of the training course, the candidate may take the examination only in the county/municipality of Bucharest in which the authorised centre where he/she completed the training is based.
Candidates who fail the first examination may take a new examination in any county or in the Municipality of Bucharest.
The examination for the professional competence certificate for taxi transport managers consists of a 60-question questionnaire to be completed in 60 minutes. Each question has four possible answers, only one of which is correct.
At least 70% of the questions, i.e. at least 42 questions, must be answered correctly in order to pass the examination.
At the end of the exam, the pass/fail score and grade obtained by each candidate are automatically displayed on the terminal screen of the PC unit where he/she took the exam.
The grade obtained in the examination can also be found on the www.arr.ro website here , under the section Certificate/attestation information, on the first working day after the examination.
The examination is organised and conducted only for candidates registered in the computerised examination system by authorised centres certifying that they have completed their professional training in accordance with the regulations in force.
For each examination session provided for in the Examination Calendar, the scheduling of candidates on that day shall be made by the Examination Board according to the specialities for which they are taking the examinations and, secondarily, in alphabetical order of candidates' names. The Romanian Road Authority - A.R.R. shall notify the training centres concerned of the schedule at least 48 hours before the exams are held and, in addition, it shall also be posted on the website: www.arr.ro.
The members of the examination committee forbid access to the examination room to candidates under the influence of alcoholic beverages or psychotropic substances, as well as to any person who is not a candidate, except in cases where the technical staff intervenes to remedy a malfunction of the electronic equipment.
The members of the examination board shall allocate to each candidate who meets the conditions for taking the examination, via the computer system, a unique examination number code for each candidate, which shall give him/her access to the grid questionnaire generated by the computerised examination system application. The numerical examination code is given to candidates when they enter the examination room.
When entering the examination room, candidates are required to fill in their full name, personal code and handwritten signature on the table provided by the examination board.
After entering the table, candidates are directed to the PC terminal/unit where they are to answer the grid-type questionnaire. Candidates access the computer-assisted examination system using the unique examination code received from the examination board.
Candidates' scores for the grid questions contained in the questionnaires generated by the computerised examination system are automatically displayed on the screen of the terminal/PC unit used by each candidate at the end of the test, including the pass/fail mark for that test.
Members of the examination board interrupt the examination of candidates who:
- use aids, technical communication or audio/video recording equipment in the examination room, or any objects/equipment that could be used for examination fraud;
- engage in discussions with other candidates, are noisy or in a manner likely to disrupt the examination of other candidates, or are not in good behaviour,
- appear for the examination under the influence of alcohol or psychotropic substances.

Have no mention in their criminal record certificate showing that they have been convicted of: offences against safety on public roads; offences relating to drug trafficking and consumption; offences against life, health and bodily integrity; offences relating to trafficking and exploitation of vulnerable persons; offences against sexual freedom and integrity; offences against property;"
Has not had his right to drive a motor vehicle suspended for driving under the influence of alcohol or narcotic substances or has not been involved in road traffic accidents resulting in victims through his own fault;
current residence in Romania.

In order to follow the course for obtaining the certificate of professional certification for passenger transport by taxi, candidates must submit a file with the following documents to the training and professional development centre authorised by the Ministry of Transport:
a) application;
b) copy of identity card;
c) the documents proving that they fulfil the conditions laid down in Article 7^1 paragraph 1. (1) letters b)-d) of Law no. 38/2003 on taxi and hire transport, as amended and supplemented, respectively:
(i) criminal record certificate, in original, certifying the absence of conviction for one of the offences referred to in Art. 9 para. (1) letter d) point 1 of Law no. 38/2003 on transport by taxi and for hire, as subsequently amended and supplemented;
(ii) a copy of the high school diploma, of the certificate of professional competence of the person designated to permanently and effectively manage the road passenger transport activity, valid, or of the certificate of professional competence of the taxi and hire transport manager, valid;
(ii) a declaration on their own responsibility concerning compliance with the condition of having a current residence in Romania, in original.
The documents referred to in para. (2) (b) and (c) (ii) shall be certified by the applicant as being in conformity with the original by writing "I, ..............................., declare on my own responsibility, under penalty of criminal law, that this document is in conformity with the original" and signing it.
